OverStream may revise these Terms of Use for its Website at any time without prior notice. By accessing this Website, accessible from https://www.overstream.net/, you are agreeing to be bound by the modified Terms of Service Agreement.

Website Use

Overstream provides certain services for music, video and live streaming which including social engagement and subscribers services (collectively, the “Services”). The Services may be purchased from OverStream. When buying any Services, you agree to pay the purchase price indicated and further agree that (a) you have the authority to make such purchases, (b) you have the authority to use or access the social media account linked to the purchase, and (c) you will not use the Services for any fraudulent or illegal purpose whatsoever.

You acknowledge and agree that all sales are final and that refunds will only be offered in accordance with the terms of this Agreement. Refunds will only be granted in the sole discretion of the Company.

Copyright

All content, including text, images, sound, video and code (collectively, the “Intellectual Property”) found throughout OverStream is the intellectual property of the Company and is protected by applicable U.S. and foreign copyright, trademark and patent laws.

Limitation Of Liability

Overstream will not be liable for any damages, liabilities or losses arising out of your use of OverStream or the Services, whether in contract, tort or otherwise. You understand and acknowledge that your use of the Services is at your own risk.

Indemnification

You agree to indemnify, defend and hold OverStream harmless from any claims arising out of, relating to, or connected with your use of OverStream or the Services. You must also indemnify, defend and hold the Company harmless based on any claim alleging facts that, if true, would constitute a breach of this Agreement.

Conduct

You agree to use the website solely for legitimate purposes and not to compromise the security of the website, make it inaccessible to others or cause damage to the content, service or website. As a user, you agree to refrain from any action that may add, subtract or modify the content of the Site. You agree to refrain from accessing the Site without permission and will not use the website in any way other than as intended.

Confidential Information

The company shall keep all information submitted to the company confidential as it relates to the processing of any order for Services. Any other content or information sent to the website shall be deemed to be non-confidential. You hereby grant the Company the irrevocable royalty-free permission to use, display and distribute the submission in whole or in part in whatever way it sees fit.

Correction Of Inaccuracies

OverStream reserves the right to correct any errors or inaccuracies in the website’s content or to change and update the content at any time without notice. Nevertheless, OverStream does not guarantee that errors, inaccuracies or omissions will be corrected immediately.

Provisions

This Terms of Service Agreement with OverStream constitutes the entire agreement between all parties with respect to the subject matter hereof.

Termination Of Service

The term of this Agreement starts when your work order is accepted by OverStream and ends when either party terminates. All payments, fees and charges made are non-refundable. If OverStream determines, in its sole discretion, that you are abusing the system, the company (without limiting any other rights or remedies available to it) will withdraw your participation and withhold any amount from you.

If you want to cancel an order or terminate an order in processing, we offer to transfer the undelivered value to other services we offer, or if a refund is necessary, we will refund the undelivered portion of the order price with a payment of 10% or $5 USD (whichever is higher).

Campaign Duration

We cannot and do not guarantee how long it will take for your marketing campaign to complete successfully. Any time frames mentioned on the OverStream website (and its subdomains), by company employees, in any chat, email, telephone conversation, or other correspondence is not a guarantee of how long the marketing campaign will take to complete successfully. Any estimate of how long a marketing campaign can take to complete successfully by the Company is simply a guideline designed to help our customers plan ahead.

Pausing Campaigns

By signing up for the services of OverStream, you accept that for any reason and without notice, OverStream reserves the right to pause your campaign. Our goal is always to deliver your order as quickly and as safe as possible; However, certain circumstances may exist, such as a page that actively loses followers or an upgrade to a social network that may make it necessary to pause your campaign. Pausing a campaign does not make you eligible for any partial or full refunds.

Account/Video Modification

You may not change, modify or delete your account, username, image and/or video while running your marketing campaign for OverStream. Doing so may make your account, photo and/or video inaccessible and cause our service to be disrupted. You agree that any change, modification and/or deletion of your account, username, photo and/or video without prior notice and approval from OverStream will make your order(s) affected subject to termination and ineligible for any type of refund.

Social Media Accounts

The company shall in no way be liable for any accounts, photos, videos and/or tracks that have been deleted due to the implementation of our services or your interaction with OverStream. It is almost impossible to determine why providers of social media accounts suspend or delete accounts or content. All purchases of the Services are at your own risk. Due to this we can not refund after services have been completed if this has occurred to the account / content.

Over-Delivery Of Service

OverStream may over-deliver the Services it guarantees, including but not limited to the delivery of extra followers or subscribers than ordered. This over-delivery amount (“Extras”) should be considered a buffer, in the event of a small loss of followers or subscribers. The extras are not covered by the Company’s Retention Guarantee and the extras are not eligible for replacement in the event of a loss equal to or less than the over-delivery amount.

Retention Warranty

The Company offers a Limited Retention Warranty with some of its services. If a customer uses one of OverStream’s Services and then loses followers, likes, views and/or reviews acquired by TwiDny’s discretion. Each service offers a different duration for OverStream’s Retention Warranty, and is indicated below:

15 days replacement warranty is provided for all services unless specified otherwise in some services description and below. If the delivered service drops below your bought amount within 15 days, please contact us for a replacement. If the service drops after 15 days, no replacement will be made.
Screenshot proofs will be provided as proof of delivery.

The Company shall make a final and non-appealable determination regarding any replacement requests.
